SUMMARY:Current Use Taxation
DESCRIPTION:Do You Qualify For Reduced Property Taxes? \nCurrent Use Taxation \nCurrent Use Vs. “Highest & Best Use”\n Current Use taxation designations provide landowners a tax break when their land use meets the criteria for farm/agricultural\, timber land\, open space\, and forest land. Current use lands are taxed according to the value of the current use instead of the market value for development\, such as residential\, commercial\, or industrial use. The development value is often called a land’s “highest and best use” which means its highest economic value if sold. However\, these programs only defer taxes while the land remains in the designated current use. For this reason\, landowners should plan to maintain these designations for the long-term. As outlined later\, penalties make short-term classification costly. \nCurrent use taxation promotes residents’ quality of life by preserving working landscapes that provide aesthetic\, economic\, and social benefits in the form of farms\, forests\, and open space. Encouraging these land uses also protects the quality of our water by maintaining vegetation and landscapes that filter and absorb storm water. \nTypes of Current Use Taxation\nFarm and Agricultural Land\nRequirements. For the three options below\, applications require the signature of all owners of the land\, a legal description\, a site plan\, and copies of IRS Farm Income Schedules for three of the previous five years. In some cases\, a Farm Management Plan may be required. \nOption One Criteria. Parcels or adjoining parcels must be twenty acres or more: 1) devoted mostly to livestock production or commercial agricultural commodity production; OR 2) registered in a federal conservation reserve program. \nOption Two Criteria. Parcels or adjoining parcels must be less than twenty acres\, but at least five acres in size generating at least \n$200 per acre annually in commercial agricultural products during three of the preceding five years. \nOption Three Criteria. Parcels must be less than five acres generating at least $1\,500 per acre annually in commercial agricultural products during three of the preceding five years. \nQualifying lands can include up to 20% of the land in compatible incidental uses (such as a woodlot) along with buildings necessary to produce\, prepare\, or sell the agricultural products (e.g.\, barns\, sheds) although potted nursery stock and greenhouse production may not count in Clark County. \nTimber Land and Designated Forest Land\nRequirements. Applications require the signature of all owners of the land and a Timber Management Plan. \nTimber Land:\n \n\nA minimum of 5 acres exclusive of the\nActively managed for growing timber for commercial\nMust submit a timber management plan prepared by a professional\nMust submit two copies of the complete application\n\nDesignated Forest Land: \n\nA minimum of 5 contiguous acres in the same ownership\, exclusive of\nActively managed for growing timber for commercial\nMust meet minimum stocking level\nMust submit a timber management plan prepared by a professional\n\nOpen Space\nRequirements. Applications require the signature of all owners of the land and relevant documentation supporting the classification. \n\nMineral deposits on parcels exceeding 20 acres – or\nArchaeological or historic sites listed on local\, state\, or national registry – or\nCertain streams or springs on parcels exceeding 10 acres – or\nCertain soil types on parcels exceeding 10 acres – or\nCertain recreational opportunities on parcels exceeding 10\nMust submit two copies of the complete application\n\n\n\n\nApplication Costs and Determining Land Value\n\n\nClassification\nCurrent Use Value\nCost to Apply *\n\n\nFarm and Agricultural Land\nBased on earning capacity on similar land determined by soil class and commodity.\n$150 application\n\n\n  \nTimber Land\nBased on land grades (composite of soil class and utility) used to determine per acre values supplied by DNR.\n  \n$2\,032 application\n\n\nDesignated Forest Land\nBased on land grades (composite of soil class and utility) used to determine per acre values supplied by DNR.\nrecording fee\n\n\nOpen Space\nBased on soil classification.\n$2\,032 application\n\n\n* As of Janurary 2015\, subject to change. Fees are non-refundable.\n\n\n\n  \nTimeline & Review Process\nIt takes over a year to process current use applications. Applications before December 31st of a given year will be processed during the following year and will apply to the taxes in the third year (application in 2004\, processed in 2005\, reduction in 2006 taxes if accepted). \nWithdrawal from Current Use Taxation\nRemoving a property’s current use taxation designation prior to ten years automatically triggers a 20% penalty (mandated by state law) in addition to back taxes. When a property is withdrawn\, the landowner must pay the deferred taxes for the previous seven years. The taxes are the difference between what was paid at the current use tax rate and what would have been paid had the property been taxed at the normal highest and best use tax rate. In other words\, that is the amount of tax that was deferred while in the current use tax designation. In addition\, the landowner will owe interest on the deferred tax amount consistent with the interest rate on delinquent taxes. \n\n\n\nClassification\nReview Process for Accepted Applications\n\n\nFarm and Agricultural Land\nApplication review. Physical inspection. Assessor records tax lien with Auditor.\n\n\n  \nTimber Land\nApplication review. Physical inspection. County Planning Commission Public Hearing. County Commissioner Public Hearing. Applicants sign Community Development agreements. Assessor records tax lien with Auditor.\n\n\nDesignated Forest Land\nApplication review. Physical inspection. Assessor records tax lien with Auditor.\n\n\n  \nOpen Space\nApplication review. Physical inspection. County Planning Commission Public Hearing. County Commissioner Public Hearing. Applicants sign Community Development agreements. Assessor records tax lien with Auditor.\n\n\n\nSelling Land in Current Use Taxation Status. The seller must pay the deferred taxes and any penalties and interest on the land being sold unless the buyer signs a Notice of Continuance on the Real Estate Excise Tax Affidavit and the Intent to Continue Current Use Classification form that demonstrate the buyer’s intent to maintain the property in the current use designation. \nPlan for this to take some extra time to be processed. In this case\, the buyer assumes the responsibilities required for the current use classification. \nCurrent Use Example\nIn the following example\, the owner of an 11 acre parcel wishes to place her land in the farm and agriculture current use designation. In this case\, the homesite is considered one acre and is taxed at market value. The remaining 10 acres will be taxed at its current earning capacity. All parcels are unique and depend on specific conditions of each property. This example is for illustrative purposes only. \n\n\n\n\n\n\n\n\n\n\n\n\nMarket Value Taxation\nCurrent Use – Agricultural Land\n\n\n  \nLand Value\n$129\,500 for 11 acres\n$3\,790 for 10 acres; One acre (homesite) @ $21\,910; Total = \n$25\,710\n\n\nStructure Value\n$48\,500\n$48\,500\n\n\nTotal Value\n$178\,000\n$74\,210\n\n\nTaxes\n$2\,670 per year\n$1\,120 per year\n\n\nDeferred Tax\n\n$1\,550 per year\n\n\n\n \n\n\n\n\n\n\n\nIn this example\, the landowner defers $1\,550 each year while in the current use classification. DESCRIPTION:Living on the Land – Class Series Teaches Land Stewardship   \nClark County\, WA – Over the past 22 years\, over 500 Clark County residents have graduated from the Living on the Land class series. The program brings in local experts to teach key stewardship principles to small acreage land caretakers.  These experts give advice on pasture and livestock management\, managing weeds\, caring for your forest\, improving wildlife habitat\, soil health\, stormwater management\, well & septic maintenance\, and more. \nThe first step to good land management is understanding the whole system. This class series begins with taking inventories and creating maps that help with goal planning.  The class then dives into soil health and fertility. The class covers pasture health and rotational grazing\, and many other topics. The watershed class teaches about dealing with stormwater and protecting nearby water bodies. Terry Koper\, Small Acreage Program Coordinator\, states\, “The variety of information these classes cover can help small acreage land caretakers dealing with a variety of land management issues.  Not only do we teach stewardship practices\, but also how to effectively manage your problem areas such as muddy pastures and weeds.” \nThe program is hosted by WSU Clark County Extension – Small Acreage Program and supported by Clark County Public Works Clean Water. This class series is on Tuesday evenings from October 7 through December 16\, 2025\, with optional field trips on Monday September 22nd noon to 1pm to showcase a forested residence and Thursday\, September 25th to highlight pasture and riverbank management.  Classes will be in-person. DESCRIPTION:Living on the Land – Class Series Teaches Land Stewardship    \n Clark County\, WA – Over the past 21 years\, over 500 Clark County residents have graduated from the Living on the Land class series. The program brings in local experts to teach key stewardship principles to small acreage land caretakers.  These experts give advice on pasture and livestock management\, managing weeds\, caring for your forest\, improving wildlife habitat\, soil health\, stormwater management\, well & septic maintenance\, and more.    \n The first step to good land management is understanding the whole system. This class series begins with advice on how to take appropriate inventories and create maps that help with goal planning.  The class then dives into pasture and teaches about rotational grazing. Soil speakers share advice on soil testing and improving your soil health and fertility.  The watershed class teaches about dealing with stormwater and protecting nearby water bodies. Terry Koper\, Small Acreage Program Coordinator\, states\, “The variety of information these classes cover can help small acreage land caretakers dealing with a variety of land management issues.  Not only do we teach stewardship practices\, but also how to effectively manage your problem areas such as muddy pastures and weeds.”  \n The program is hosted by WSU Clark County Extension – Small Acreage Program and supported by Clark County Public Works Clean Water. This class-series is on Tuesday evenings from October 1 through December 3\, 2024\, with an optional field trip on Saturday\, September 28th.  Classes will be in-person. DESCRIPTION:Join us for a Biochar Burn Demonstration and Small Acreage Woodland Tour!\nSaturday\, June 29th 8:00am-3:00pm at a small acreage residence in Ridgefield\, WA.\nCome take part in the biochar burn with a Ring of Fire Biochar Kiln\, which is ideal for making biochar on your own small acreage with small diameter wood from your own woodland. Biochar is a type of charcoal that is burned at a specific temperature range and with limited oxygen. Biochar has many benefits as a soil amendment\, including: retaining moisture; sequestering carbon; and when combined with nutrients\, such as compost\, it can offer long-term soil fertility improvements. The biochar burn setup will begin promptly at 8am. When the burn is finished (likely between 11am-2pm) we will begin an hour-long tour of the woodland and learn about best management practices for watershed and small acreage woodland health. Join the WSU Extension Clark County Master Gardener program for a fully hands-on\, workshop on vegetable gardening. Saturday\, May 20 from 9am to 2:30pm in Hazel Dell (Vancouver)\, WA. Participants will learn about site selection\, soil preparation\, crop selection\, pest and disease management\, irrigation\, and more. This is a fully hands-on outdoor event. Dress for the weather. Wear sturdy shoes and bring water. Bring a lawn chair if you’d like to sit at each of the four stations. Vancouver\, WA (exact location provided upon registration.)
